Q.  If I have an Idea for a particular invention, what happens if there is an existing patent or similar item and that item is not being marketed? -Phil

A.  Thanks for your e-mail, Phil.  There's two things you might consider.  First, if you feel strongly about this product and have a feel for the market you might ask the inventor for the "exclusive rights" to this product.  If the inventor doesn't want to give up all the marketing rights, you might ask for the exclusive mail order rights, etc.  The second thing you might consider is purchasing the patent.  If the inventor is not having much luck selling his product he might let it go for a song. - Gary

Q.  Hi Gary, should I make a prototype and then try to sell it, or patent it first so no-one steals my idea? - Marcie

A.  Thank you for your e-mail regarding your invention idea.  I would suggest you do a patent search first.  Reason being, you don't want to invest in an idea if it's already patented. - Gary
